(Munich, Diemelsee-Flechtdorf, October 30th , 2009) Weidemann GmbH, an affiliate of Wacker Neuson SE, has won a legal dispute against a Danish importer. The Danish company commissioned an unauthorized replica of Weidemann’s Hoftrac 1140 model to be built in China and proceeded to market it under the name ‘Job-Mann 100-30’, thus violating fair trade rules. With immediate effect, the importer and several dealers in Germany are prohibited from distributing this duplicate in Germany. The ruling has been acknowledged by both parties and is therefore legally binding. Proceedings to ban an imitation of the Weidemann Hoftrac 1250 model distributed under the name ‘Job-Mann 200-35’ are pending.

Top priority for patent protection
“We use a number of instruments to protect our high-quality products and IP and take a hard line against companies that violate our protected rights. The “slavish imitation” of products is also prohibited and is something we do not tolerate. So this ruling has confirmed our stance and we are very pleased with the outcome”, explains Hans-Heinrich Schmidt, General Manager for Development and Production at Weidemann GmbH. With immediate effect, the company Dig-In ApS (Vojens, Denmark) is not permitted to export an imitation of Weidemann’s Hoftrac 1140 under the name ‘Job-Mann 100-30’ to Germany, market it there or allow it to be distributed by a third party. Imitations that have already been illegally imported may not be rented. Dig-In ApS has acknowledged the injunction. Furthermore, the company has been ordered to provide Weidemann GmbH with a sales inventory, outlining dates, unit sales, revenue, profit, distributors and direct customers. Dig-In ApS is also instructed to pay a six-figure sum in damages to Weidemann GmbH. Proceedings to ban an imitation of the Weidemann Hoftrac 1250 distributed under the name ‘Job-Mann 200-35’ are pending.
